2014-18 Distant Signal Retransmission Tariff Hearing (Copyright Board of Canada)

We represented FWS Joint Sports Claimants (a copyright collective comprised of the NHL, NFL, NBA, and CFL sports leagues) in proceedings to determine the royalties to be paid by cable and satellite systems for the retransmission of distant televisions signals carrying league games. The hearing took place during four weeks in 2016. A decision is pending.

Canplas Industries Ltd. v Airturn Products Inc and Merit Precision Moulding Ltd. (Federal Court File Nos. T-366-11 and T-719-14)

We represented the plaintiff in a patent infringement action relating to passive roof vents. The matter settled on the 2nd day of a scheduled three-week trial.

Advantage Products Inc v Excalibre Oil Tools Ltd. (Federal Court File Nos. T-1741-08 and T-1946-09)

We represented the plaintiff in patent infringement action relating to downhole torque anchors for use in oil wells. Following a three-week trial , the Court found that one patent was invalid, one patent was valid and not infringed, and one patent had several valid claims that were not infringed (2016 FC 1279). The decision is currently under appeal.

Frac Shack Inc v AFD Petroleum Ltd. (Federal Court File No. T-2149-14)

We represented the plaintiff in a patent infringement action relating to a system and method for fuel delivery at an oil or gas well site. Following a three-week trial the Court found that several claims of the patent were valid and infringed, and awarded an injunction, an accounting of profits, reasonable compensation for pre-issue infringement, and legal costs (2017 FC 104).

National Oilwell Varco Downhole Eurasia Ltd. v TLL Oilfield Consulting Ltd. and Acura Machine Inc (Federal Court File No. T-1280-13)

We represented the plaintiff in patent infringement proceedings relating to a fluid pulsing apparatus for use in an oil well. The action was settled a few weeks before a three-week trial scheduled for March 2017.

DNOW Canada ULC and National Oilwell Varco Inc ats Grenke (Federal Court File No. T-1236-01)

We represented National Oilwell Varco against a claim for damages for patent infringement. The patent related to a stuffing box for use on an oil wellhead drive. A three-week trial was held in May 2017, and a decision is pending.
